1. Use of this website
By using everclearwindows.com.au you agree to these Terms. We may update them from time to time; the current version is always posted at this URL. Continued use after an update constitutes acceptance.
2. Information accuracy
We aim to keep information on this website accurate and current. Specifications, lead times and pricing on the site are indicative only and may change without notice. Formal written quotes prevail over website information.
3. Intellectual property
All content on this website - including text, images, layout, and code - is owned by Everclear Windows & Doors or its licensors. You may not reproduce, distribute or use it without permission, except for personal, non-commercial use.
4. Quotes & orders
Quotes are valid for 30 days from issue unless stated otherwise. Quotes become orders only on written acceptance from you and receipt of any required deposit. We reserve the right to decline or revise an order if circumstances change materially between quote and acceptance.
5. Payment terms
For installation work, a deposit is typically required to commence manufacture, with the balance due on completion. For repair work, payment is generally due on completion. Specific payment terms are outlined on each quote and invoice.
6. Lead times & scheduling
Manufacturing and installation timeframes are estimates. We do everything reasonable to meet stated dates but cannot accept liability for delays caused by suppliers, freight, weather, site access or other circumstances outside our control.
7. Warranty
All Everclear-installed products carry a workmanship warranty (typically 12 months) plus the relevant manufacturer warranty (typically 7–10 years on hardware, 10+ years on aluminium frames). Specific warranty terms are provided in writing with every quote and product. Warranty is conditional on reasonable maintenance and does not cover damage from misuse, accident, force majeure, or modification by third parties.
8. Australian Consumer Law
Nothing in these Terms limits or excludes your statutory rights under the Australian Consumer Law. Where ACL guarantees apply, our liability is limited to the maximum extent permitted by law.
9. Liability
To the maximum extent permitted by law, we exclude liability for indirect or consequential loss arising from use of this website or our services. Our total liability for any claim is limited to the amount paid to us under the relevant order.
10. Cancellation
Orders may be cancelled in writing prior to manufacture commencement, in which case any deposit may be refunded less reasonable costs incurred. Cancellation after manufacture has commenced may not be refundable. Specific cancellation terms are outlined on each quote.
11. Governing law
These Terms are governed by the laws of New South Wales, Australia. Any disputes will be resolved in the courts of NSW.
